Receiver's 2/28/08 Status Update for Customers of Nations Investments

1. Interim Distribution

The Court has signed the Consent Order authorizing the Receiver to make an interim distribution to all forex customers holding a balance on August 17, 2007. The Receiver will begin making interim distributions to customers with valid forex accounts.

2. Litigation

On February 7, 2008, the CFTC filed its First Amended Complaint adding additional claims against Sal Husain and Sammy Joe Goldman, and seeking additional civil monetary damages for violations of the Commodity Exchange Act and NFA rules. The CFTC’s Amended Complaint also names Manny Husain, Lalita Husain and Rosalind Goldman as defendants.

On February 8, 2008, the Receiver filed his Emergency Motion seeking to compel Sal Husain to cooperate with the Receiver in his efforts to maximize recovery of the company’s assets for the benefit of its customers and creditors.

On February 18, 2008, the Receiver filed his Cross-Claim and Third Party Complaint seeking to recover damages against the defendants for fraudulent transfer of company assets and breach of fiduciary duties.

3. Tax Information

If you have not received your Form 1099, it will be forthcoming and will arrive in time for preparation of your 2007 tax return.
